This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A4, in Crime No.275 of 2017 on the file of Ongole I Town Police Station, Prakasam District. The offences alleged are under Sections 420 and 506 r/ w 34 IPC. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that the role of A4 is not material and that it is A1 and A2, according to the case of the prosecution, who induced the complainant to pay the money. 4.

A perusal of the complaint shows that A1 and A2 represented to the de facto complainant that they would provide job to him and on that pretext they took amount from him and later informed that they handed over the entire amount to A3 and A4.

The counsel for the petitioner files before this court enrolment form of SAP Authorised training, in support of his contention that the de facto complainant has undergone training and the fee paid was towards the training fee. 6.

But the Public Prosecutor does not admit the genuineness of the document, on the ground that it does not contain the signatures of any of the accused, much less of A4.

In the above circumstances, the said document cannot be taken into consideration. From the above allegations, prima facie, it appears that the petitioner has committed the alleged offences. The nature of the offences does not entitle the petitioner for an anticipatory bail. Hence, this court opines that this is not a fit case for granting anticipatory bail. 8.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
