ORDER

This petition is filed under Section 407 of Cr.P.C., to withdraw C.C.No.986 of 2017 pending on the file of I Additional Judicial First Class Magistrate at Khammam and transfer to any other Court at Vijayawada.

The main allegation made by the petitioner is that the police at Khammam are interfering and threatening him whenever he is appearing before the Court at Khammam in connection with the cases pending between the parties and therefore, he is apprehending danger to his life in the hands of the police. In support of his contention he has drawn the attention of this Court to the counter filed in the earlier petition in Tr.C.M.P.No.575 of 2017 filed by the second respondent before this Court for transfer of FCOP No.50 of 2017 from Srikakulam to Khammam District. 3.

The second respondent opposed the petition by filing a counter stating that she is a permanent resident of Khammam and if the case is transferred, she will face much difficulty to appear before the Court.

In view of the serious allegations made against the police at Khammam by the petitioner, I deem it appropriate to withdraw C.C.No.986 of 2017 pending on the file of I Additional Judicial First Class Magistrate, Khammam and transfer to the file of Judicial

MSM,J Tr.Crl.P.No.8 of 2018 Magistrate of First Class, Madhira, which is at a distance of 100 kms from Khammam, subject to payment of expenses by the petitioner for appearance of the second respondent before the Court in connection with the said case for recording her evidence and other witnesses.

Accordingly, the Transfer Criminal Petition is disposed of . Miscellaneous petitions, if any, pending in this petition shall stand closed.
