THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5662 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by petitioners/accused Nos.1 and 2 seeking to quash the C.C.No.281 of 2015 on the file of the III Special Magistrate, Malkajgiri, Ranga Reddy District, for the offence under Section 138 of Negotiable Instruments Act. Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

In any event, considering the nature of allegations against the petitioners-accused Nos.1 and 2, presence of the petitioners-accused Nos.1 and 2 before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment. However, the petitioners-accused Nos.1 and 2 shall be properly represented through their counsel before the trial Court.

Accordingly, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
