Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed therein, the High Court may be pleased to enlarge the petitioner/accused No.5 on bail in NDPS SC. No. 174 of 2016 on the file of I Additional Sessions Judge, Rajahmundry in Crime No. 21 of 2016 on the file of Mothugudem Police Station, East Godavari District; The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Rajasekhar Tulasi, Advocate for the Petitioner and of Additional Public Prosecutor(AP) on behalf of Respondent-State, the Court made the following ORDER :- "This Criminal Petition is filed by the petitioner/A-5 under section 437 and 439 Cr.P.C., seeking to grant bail to the petitioner, who is A-5 in Crime No. 21 of 2017 of Mothugudem Police Station, East Godavari district, registered for the offences punishable under section 8 [c] read with section 20 [b] [ii] [c] of Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Heard both sides.

3. The counsel for the petitioner/A-5 submits that A-4 who stands on the same footing as that of this petitioner/A-5 was already enlarged on bail by virtue of the orders passed by this Court in Crl.P.No. 4051 of 2017, dated 14/06/2017. Learned Additional Public Prosecutor does not refute the fact that this petitioner stands on the same footing.

4. In the circumstances, this Criminal Petition is allowed and the petitioner/A-5 is directed to be released on bail on his executing a personal bond for Rs.1,00,000=00 [Rs. One lakh only] with two sureties for a like sum each to the satisfaction of I-Additional District and Sessions Judge, East Godavari district at Rajahmundry.

5. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
