Admittedly as on date the remedy of appeal is effective and also available. As the remedy of appeal under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (for short 'the Act') is an effective and efficacious alternative remedy, I am not proposing to examine the merits of the case under Article 226 of the Constitution of India. The writ petition is accordingly dismissed by leaving it open to the petitioner to pursue the statutory remedy of appeal under the provisions of the Act. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
