THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.1673 of 2016 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/A.1 in C.C.No.315 of 2008 on the file of the Court of the I Additional Judicial First Class Magistrate at Mancherial, Adilabad District.

The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with liberty to file a petition under Section 70 (2) Cr.P.C. before the trial Court to recall the Non-Bailable Warrant issued against him. Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for. However, the trial Court is hereby directed to dispose of the petition, if any, filed by the petitioner/A.1 under Section 70 (2) Cr.P.C. to recall the Non-Bailable Warrant on the same day taking into consideration the transfer of the matter from one Court to another Court.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
