Gaddam Pedda Venkateswarlu, S/o Somaiah, Aged about 80 years, Occu: Cultivation, R/o Pathagollapalem village, Peddaganjam Grampanchayat, Chinnaganjam Mandal, Prakasam district.
.....Petitioner and State of Andhra Pradesh, rep.by its Principal Secretary to Government, Revenue Department, Secretariat, Velagapudi, Amaravathi, Guntur District and others.
.....Respondents The Court made the following:
HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims that D-form patta was granted to him on 21.04.2001 to an extent of Ac.4.00 cents of land in Sy.No.553/1 of Peddaganjam Revenue Village and subsequently he was granted pattadar pass book and title deed in respect of the said land. While so, respondents are trying to dispossess him from the subject land without following due process.
2.
Learned Government Pleader, on instructions, though disputes the claim of the petitioner about the granting of patta in favour of petitioner, contends that in fact, patta was granted as early as in the year 1975 to another person, seeks leave of the Court to permit the respondents to follow due process in the event of dispossessing the petitioner, if he is in possession. 3.
Having regard to these submissions, without going into the merits, writ petition is disposed of, granting liberty to the respondents to follow due process to cancel the patta, if such patta was granted and to dispossess the petitioner if he is in possession, on due verification of the revenue records and ground realities. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO Date: 19.09.2017 kkm
