This writ petition is filed seeking a writ of mandamus, declaring the notification No.Rc.G2/638/2007, dated 03.02.2007, issued by respondent No.1 under Section 4(1) of the Land Acquisition Act, 1894 (for short "the Act"), published in Vaartha Telugu Daily, Nellore Edition, dated 06.02.2007, proposing to acquire Ac.2.40 cents of wet land, i.e., Ac.1.56 cents, Ac.0.84 cents comprised in Sy.Nos.213-5 and 213-6 respectively belong to the 1st petitioner and Ac.1.54 cents of wet land comprised in Sy.No.214-1B belong to the 2nd petitioner, situated in Vinnamala village, Naidupet Mandal, Nellore District, as illegal, arbitrary and contrary to the provisions of the A.P.Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 and also violative of the provisions of the Act and consequently set aside the same.

Heard Sri V.Sudhakar Reddy, learned counsel for the petitioners and the learned Government Pleader for Land Acquisition. When the matter is taken up for hearing, on instructions, the learned Government Pleader for Land Acquisition has informed this court that the respondents do not intend to acquire the lands of the petitioners for the present for any purpose.

In view of the above submission made by the learned Government Pleader, the cause in this writ petition does not survive, and accordingly, the writ petition is closed. However, it is needless to state that whenever the respondents intend to acquire the lands of the petitioners for any

AKS,J WP_9832_2007 public purpose, they may do so by following due process of law. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
