HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18222 of 2016 ORDER:

This writ petition is filed by the petitioner seeking Mandamus declaring the action of respondent Nos.3 to 5 and their subordinates in interfering with the petitioner's business and his personal life and liberty, as illegal, arbitrary and violative of Articles 14, 19(1)(g) and 21 of the Constitution of India and consequently sought a direction to the respondents not to interfere with the petitioner's business activity and his personal liberty.

The averments in the affidavit filed in support of the writ petition would show that the petitioner is running business in jaggery since 2012, after obtaining necessary permission from the authorities concerned. It is averred that in spite of the same, the respondent - Police are interfering with the business activity of the petitioner and harassing the petitioner from conducting the business. On the other hand, the learned Government Pleader for Prohibition and Excise denies the said allegations. Having regard to the facts and circumstances of the case, respondent Nos.3 to 5 are directed not to harass the petitioner by interfering with its business activity, except following the due process of law.

Subject to the above direction, this writ petition is disposed of, at the admission stage. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
