This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused No.2 to recall the Non-bailable Warrant issued against him by the learned III Metropolitan Magistrate, Cyberabad at L.B.Nagar, Hyderabad, in C.C.No.190 of 2016.

Heard the learned counsel for the petitioner/ accused No.2, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioner/ accused No.2 would submit that a direction may be given to the Court below to consider the recall application of the petitioner/ accused No.2, on the date of filing itself.

No such time can be stipulated, as contended on behalf of the petitioner/ accused No.2, under the facts and circumstances of the case. However, in the event of the petitioner/ accused No.2 filing an application before the Court below to recall the Non-bailable Warrant issued against him, the Court below is directed to dispose of such application expeditiously, in accordance with law.

With the above observation, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
