THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Ms. JUSTICE J. UMA DEVI Writ Appeal No.1333 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the ad-interim order passed by the learned Single Judge in W.P. No. 21969 of 2017 dated 4.7.2017, as extended from time to time.
When we asked Sri S. Niranjan Reddy, learned Senior Counsel appearing on behalf of the appellant, as to why we should exercise discretion under Clause 15 of the Letters Patent to interfere with the ad-interim order passed by the learned Single Judge, when the appellant can as well seek vacation of the interim order, learned Senior Counsel would submit that, despite a petition being filed seeking vacation of the interim order, the adinterim order is being extended from time to time; and the appellant was, therefore, constrained to invoke the jurisdiction of this Court under Clause 15 of the Letters Patent. As the appellant has filed a petition to vacate the interim order passed earlier, it is but appropriate that the appellant, in case there is an urgency in the matter being heard early, requests the learned Single Judge to take up the vacate stay petition at an early date. We have no reason to doubt that, upon such a request being made, the learned Single Judge would give it its due consideration.
The Writ Appeal is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
