HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.6647 OF 2010 ORDER:
The relief sought for in this Writ Petition is for a mandamus to be issued to the respondents to take action for removal of the illegal business being run at 1-1-379/184, Part 60, Jawaharanagar Chikkadpally, Hyderabad. The petitioner alleges that, despite oral and written complaints by him, no action has been taken against the fourth respondent for running a chicken/mutton shop, though such shops are prohibited in a residential area.
Sri Siddartha Sarma, Learned Standing Counsel for the GHMC, on instructions, states that the authorities had verified the subject shop, and found a Xerox centre being run thereat; the averment in the writ affidavit, that mutton shop is being run in the subject premises, is incorrect; officials of the GHMC had the subject shop verified today in the fore-noon; and there is no chicken/mutton shop in existence in the subject premises.
In the light of the submission of Sri Siddartha Sarma, Learned Standing Counsel, that there is no chicken/mutton shop in the subject premises as on date, it is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed.
