THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.11289 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the in action of the respondents in not disposing the appeal of the petitioner dated 16-6-2016 as illegal, arbitrary, and in violation of Article 14 and 19(g) of the Constitution of India and consequently direct the respondents to permit the petitioner to run the sawmill till the disposal of the appeal dated 16-6-2016 pending before the 3rd respondent."

Heard Sri S.Krishna Sarma, learned counsel for the petitioner, and the learned Government Pleader for Forests (A.P.) appearing for the respondents.

Admittedly, in the present case, the appeal filed by the petitioner on 16.06.2016 against the order, dated 03.06.2016, of respondent No.5 under Rule 9(2)(a) of A.P. Saw Mills (Regulation) Rules, 1969 is pending consideration before respondent No.3. 4.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Forests, this Court is of the considered view that the ends of justice would be served if respondent No.3 is directed to pass appropriate orders on the appeal, dated 16.06.2016, filed by the petitioner against the order, dated 03.06.2016, passed by respondent No.5 within a time frame.

For the aforesaid reasons, the Writ Petition is disposed of, directing respondent No.3 to pass appropriate orders on the appeal, dated 16.06.2016, said to have been filed by the petitioner herein against the order, dated 03.06.2016, of respondent No.5 within a period of one month from the date of receipt of a copy of this order in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
