THE HON'BLE SRI JUSTI CE SANJAY KUMAR CRI MI NAL PETI TI ON Nos.26, 27, 28, 33, 37 and 38 of 2019 COMMON ORDER:

The petitioners in this batch of cases are individual Directors of Axis Bank Limited who were arrayed amongst the accused in Crime No.57 of 2011 on the file of Panjagutta Police Station, Hyderabad, which was registered under Sections 420, 120B, 406 and 34 IPC. By way of these petitions filed under Section 482 Cr.P.C., the petitioners seek quashing of the proceedings in the said crime.

Sri N.Naveen Kumar, learned counsel for the petitioners in this batch of cases, would inform this Court that the Axis Bank Limited and some of the other Directors of the said bank who were also shown as the accused in Crime No.57 of 2011 on the file of Panjagutta Police Station, Hyderabad, filed Crl.P.No.1405 of 2011 to quash the proceedings therein and by order dated 22.12.2017, a learned Judge of the combined High Court for the States of Telangana and Andhra Pradesh allowed the said case and quashed the proceedings in Crime No.57 of 2011 on the file of Panjagutta Police Station, Hyderabad, in so far as the petitioners therein were concerned.

A copy of the said order is placed on record and perusal thereof reflects that quashing of the proceedings in the crime was not on any ground which was individual to the petitioners therein. In that view of the matter, the cases on hand are squarely covered.

For reasons alike as were stated in the order dated 22.12.2017 passed in Crl.P.No.1405 of 2011 and in terms thereof, these criminal petitions are allowed quashing the proceedings in Crime No.57 of 2011 on the file of Panjagutta Police Station, Hyderabad, in so far as the petitioners are concerned.

Pending miscellaneous petitions in these cases, if any, shall stand closed in the light of this final order.
