THE HONOURABLE SRI JUSTICE K. LAKSHMAN I.A.Nos.2 & 3 of 2021 IN/AND CRIMINAL PETITION No.45 OF 2021 COMMON ORDER:

This Criminal Petition is filed by the petitioners/accused Nos.1 to 12 in Crime No.965 of 2020 on the file of Jawaharnagar Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 143, 147, 323, 324, 448, 427, 504 read with Section 149 of IPC and Sections 3(1)(r)(s) and 3(2)(va) of the SCs/STs (POA) Act, to quash the proceedings in the above said crime. 2.

During the pendency of the present Criminal Petition, the parties have compromised the matter and, accordingly, respondent No.2-de facto complainant filed I.A.Nos.2 and 3 of 2021 to permit him to compromise the matter and to compound the offences in Crime No.965 of 2020. 3.

Vide order dated 08.01.2021, this Court, after recording the submissions made by the learned counsel for the petitioners as well as respondent No.2, directed the parties to appear before the Secretary, Telangana High Court Legal Services Committee, Hyderabad, on or before 03.02.2021 for their identification and also directed the Secretary to submit a report by 04.02.2021. In compliance with the said order dated 08.01.2021, the Secretary has submitted his report dated 22.01.2021.

In the report of the Secretary, Telangana High Court Legal Services Committee, Hyderabad, it is stated that on oral examination, respondent No.2 has stated that he had filed a complaint against the petitioners before Police Station, Jawaharnagar, Rachakonda Commissionerate, and that same has been registered as Crime No.965 of 2020 dated 12.12.2020 for the offences under Sections 143, 147, 323, 324, 448, 427, 504 read with Section 149 of IPC and Sections 3(1)(r)(s) and 3(2)(va) of the SC & ST (POA) Act, and that now he has approached this Court for recording the compromise. 5.

The parties herein have filed a joint memo of compromise dated 04.01.2021. The said joint memo of compromise and the report of the Secretary are placed on record.

In view the said report and also in view of the compromise entered between the petitioners and respondent No.2, I.A.Nos.2 and 3 are allowed. Consequently, the Criminal Petition is allowed and the proceedings in Crime No.965 of 2020 on the file of Jawaharnagar Police Station, Rachakonda Commissionerate, are hereby quashed.
