THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.1811 of 2013 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.M.P.No.24 of 2013 in W.P.No.24 of 2013 dated 04.01.2013. In the said order, this Court noted that the order of the Tahsildar dated 08.08.2012, for incorporation of the names of respondents 4 to 6 in the revenue records, was stayed by the Revenue Divisional Officer on 21.09.2012. On being informed that the interim order passed by the Revenue Divisional Officer continued to remain in force, despite which the Tahsildar had amended the revenue records in favour of the eleventh respondent without putting the petitioners on notice, this Court granted interim stay. The present Contempt Case is filed alleging that the VRO issued adangals wherein the name of the eleventh respondent continues to be shown as the pattadar.

Learned Government Pleader for Revenue would point out that the very basis of the aforesaid order of this Court is that the interim order passed by the Revenue Divisional Officer continued to remain in force; subsequently, the appeal preferred by the petitioners was dismissed by the Revenue Divisional Officer; and, consequently, the petitioners cannot now complain of violation of the order of this Court. As the appeal preferred by the petitioners was dismissed by the Revenue Divisional Officer subsequently, the petitioners cannot now be heard to contend that the interim order passed by this Court, which was passed on the basis that the interim order passed by the Revenue Divisional Officer was in force, has been violated. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act, 1971.

The Contempt Case is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
