THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.29663 of 2013 Order:

This Writ Petition is filed to declare the action of the respondents 1 and 2 in insisting the petitioners to demolish their residential houses without issuing any notice and without following due process of law in spite of the permission granted by the second respondent as illegal and arbitrary.

When the matter is taken up for hearing, Sri G. Seshadri, learned Standing Counsel appearing for the second respondent, submits that the petitioners have approached the Court on mere apprehension and that no notices were issued to the petitioners herein. Having regard to the facts and circumstances of the case and in view of the said submission made by the learned Standing Counsel, the Writ Petition is disposed of directing the respondents not to demolish the houses of the petitioners without following due process of law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
