HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.8527 OF 2015 ORDER:
Heard learned counsel for the petitioner and the Government Pleader. The petitioner prays for Mandamus declaring the insistence of 4th respondent to get 'No Objection Certificate' from Revenue authorities for registration of land in an extent of Ac.4-81 cents in Survey No.10-3 of Erramanchi Village, Polam, Penukonda Mandal, Anantapur District, as illegal and arbitrary. The complaint of petitioner is that the insistence to produce NOC is unsustainable in fact and law and without receiving the document for registration or processing the same in accordance with law, the 4th respondent is acting beyond the jurisdiction conferred on him by the Registration Act,1908. The learned Government Pleader, on instructions, submits that the grievance complained in the writ petition is mere apprehension and the 4th respondent is ready to receive and process the document for registration and pass appropriate orders in accordance with law.
The statement is placed on record. Accordingly, the writ petition is disposed of. No order as to costs.
