THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.12318 OF 2014 ORDER:

This writ petition is filed by 70 petitioners challenging the proceedings, dated 04-04-2014 directing the Special Officers of Kasthuribhai Gandhi Balika Vidyalaya to handover the complete charge of the post of Special Officers to the newly contracted Special Officers by 21-04-2014 and get themselves relieved by 21-04-2014.

This Court, vide order, dated 21-04-2014 passed the following order:

"All the petitioners are said to be on deputation. IN view of the earlier rounds of litigation before his Court, there is no legal impediment to repatriate the petitioners to the parent departments. At any rate, in the present writ petition, the petitioners raised an objection that their transfer or repatriation, whichever way it is referred to, shall be in conflict with the model code of conduct imposed by the Election Commission for the ensuing general elections.

In the light of the model code of conduct, there shall be interim direction not to effect repatriation or transfer of any of the petitioners, if they are assigned for election duty, and in such an event, it is open for the authorities to obtain prior permission from A.P. Election Commission, if exigency of administration warrants, and effect the transfers thereafter."

Seeking vacation of the said order, WVMP No.2045 of 2014 is filed. A perusal of the above order shows that the order worked out itself consequent to the completion of selection process. Now regular Special Officers are appointed on contract basis by the Kasthuribhai Gandhi Balika Vidyalaya and the petitioners are working on deputation. Their substantive posts are School Assistants in the respective Zilla Parishad. In the circumstances, they cannot have any grievance to the order, dated 04-04-2014, which directed them to handover the charge to the newly contracted Special Officers.

In view of the same, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
