THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.18119 OF 2010 ORDER:
The petitioner invoked the jurisdiction of this Court under Article 226 of the Constitution of India questioning the action of the respondents in disconnecting power supply despite the fact that there was no violation on the part of the petitioner. By the interim order, in WP.MP.No.22887 of 2010 dated 17.06.2014, electricity connection was directed to be restored to the petitioner; and, for the past more than three years, the said interim order is still in force.
While the impugned proceedings does appear to support the petitioner's case that disconnection of power supply was despite their not having committed any violation, suffice it to make it clear that the petitioner's electricity connection shall not be disconnected, except after putting him on notice for any violation; and after giving him an opportunity of being heard. The Writ Petition stands disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
