THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27928 of 2017 ORDER:
This Writ Petition is filed seeking the following relief: "to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of Respondents 3 to 6 in insisting the 1st petitioner to close his wine shop M/s Sri Anjaneya Wines established pursuant to form-A-4(B) with licence No WG /70/A4(B)/2017-19 issued by 2nd respondent located at Door No 6-32 in Kamavarapukota Village and Grama Panchayat Limits of West Godavari District, as illegal irregular irrational violative of principles of natural justice and provisions of Andhra Pradesh Excise Act 1968 and rules framed there under and offends Articles 14, 19 and 21 of Constitution of India and consequently direct the Respondents not to interfere in any mummer with 1st petitioner's said wine shop business in the said shop premises."

Learned Government Pleader for Prohibition and Excise received written instructions stating as follows: "I submit that no pressure was given to Sri Mohammed Sayyed Bajee S/o Abu Saleha R/o Pothavaram, Licensee of M/s. Sri Anjaneya Wines, Kamavarapukota, L.No.WG/70/2017-19 from the Prohibition and Excise Department i.e., by respondents 3 to 5. In fact the A4 shop at this licenced premises is functioning smoothly without violating any Excise Rules. Hence, there is no necessity to the Prohibition Excise Department to insist the licensee to vacate the premises."

It is further stated that there is a civil dispute between the 2nd petitioner and the Panchayat authorities of Kamavarapukota Village and the Department is not concerned with the same.

In view of the same, no further orders are necessary in the present Writ Petition and accordingly, the Writ Petition is closed recording the written instructions issued to the learned Government Pleader.
