SMT JUSTICE T.RAJANI CRIMINAL PETITION No.183 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.1, in Crime No.619 of 2017 of Krishnalanka Police Station, Vijayawada City.

The offences alleged are under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The quantity of ganja involved in this case is 290 Kgs. The learned counsel for the petitioner submits that this petitioner is not found to be in possession of the ganja. But, the confessional statement of the petitioner itself shows that he is the person who has been securing ganja and dealing with a ganja with the help of other people and also police officials. The other contention of the learned counsel that the petitioner may be granted bail as he has been in jail since four months, cannot be considered, as Section 37 of the Act does not entitle the petitioner for a bail, in the above circumstances.

Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. ______________________ T. RAJANI, J Date: 23.01.2018.
