THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2770 OF 2016 ORDER:

This petition is filed by the petitioner-A3 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.1045 of 2002 on the file of the X Metropolitan Magistrate, Secunderabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 465, 468, 469, 471 and 420 r/w 34 IPC. The petitioner approached this Court after a period of 14 years from the date of filing of the charge sheet against him. It is brought to the notice of this Court that the trial is pending in the above C.C. In the circumstances, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioner submitted that the presence of the petitioner before the trial Court may be dispensed with.

In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner shall be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of.
