Kadam Kandoji v. Smt. Vanajakshi
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1478 OF 2017 ORDER:
This contempt case is filed alleging non-implementation of the order of this Court dated 25.02.2009 passed in W.P.No.1466 of 2009. The said writ petition was allowed restraining the respondents therein from dispossessing the petitioners from the land situated in R.S.Nos.977/P, 977/1, 979 and 980/P of Nuzvid Village and Mandal, Krishna District stated in the affidavit.
Now learned counsel for the petitioners submits that there is a threat of dispossession in spite of the order of this Court. If there is a threat of dispossession, it cannot be called as a contempt and the petitioners have other alternative remedies.
In view of the same, the contempt case is not maintainable and is accordingly dismissed.
