THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.21632 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the official respondent Nos.3 and 5 in considering the petitioner's representation dated 30.04.2016 requesting to stop the ongoing illegal and unauthorized construction being raised by unofficial respondent No.4 in petitioner's land admeasuring 1060 square yards situated at N.R.P. Agraharam, Undi, bounded by East: Wall of K.Venkateswarly, South: Undi canal, West: site of K.Krishna Rao and North: Public Road, as illegal, arbitrary, without right and title, against the principles of natural justice and in violation of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the official respondent Nos.2, 3 and 5 to remove the illegal and unauthorized construction being raised by respondent No.

4 in the petitioner's property. The grievance of the petitioner is that the fourth respondent making constructions without obtaining necessary permission from the Panchayat Secretary, N.R.P. Agraharam Gram Panchayat, Undi Mandal, West Godavari District. The petitioner herein submitted a representation to the third respondent on 30.04.2016 and the same is pending before him. The only grievance of the petitioner is that the third respondent is not taking any steps to dispose of the petitioner's representation.

Having regard to the facts and circumstances of the case, the third respondent is hereby directed to dispose of the representation of the petitioner dated 30.04.2016 in accordance with law, as early as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
