SMT JUSTICE T.RAJANI CRIMINAL PETITON No.19 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A4, in Crime No.70 of 2017 on the file of Varadaiahpalem Police Station, Chittoor District. The offences alleged are under Sections 143, 147, 448, 384, 307, 427, 353 r/w 149 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that there are absolutely no allegations against this petitioner and that the allegation is only that he abused the head constable. But, the allegations against A1 are that he is transporting sand illegally and when police intervened, he assaulted on the police and this petitioner was also along with A1 and he was standing in support of A1, which can be gathered from the fact that he abused the police in filthy language. 4.

Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed.

However, the petitioner can file a petition seeking for regular

bail by surrendering himself before the court below and obtain regular bail as was done by the other accused. 6.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 22.01.2018 SS
