O R D E R

This writ petition is filed to declare the Municipal Counsellors of Mahbubnagar Municipalities elected on 12.05.2014 as disqualified, on the ground that they have taken oath on 03.07.2014 with a gap of 52 days from the date of declaration of results whereas as per Section 120 of the Municipal Counsellors Act, the prescribed period for taking oath is only 45 days.

When the matter was taken up for hearing on 19.01.2015, there was no appearance for the petitioner. As such, the matter was directed to be posted for dismissal on 20.01.2015.

Even today, there is no representation for the petitioner.

Learned Standing Counsel for the respondents submits that there is no prescribed period of 45 days for taking oath by the counsellors, as stated by the petitioner and that there is no provision of law enacted by the State of Telangana prescribing such period. As such, the same is not applicable in this case. More so, the effected persons are also not made parties in this writ petition In view of the above, I do not see any merit in entertaining the writ petition. Accordingly, the writ petition is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
