Mohd. Amith v. The State Of Telangana
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.5 0 of 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.26 of 2017 on the file of Balapur Police Station, Rachakonda District. The offences alleged are under Sections 382, 420 and 506 r/ w 34 IPC. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The counsel for the petitioner submits that the case is registered based on the private complaint and that as per the complaint, the incident occurred on 30.03.2017 and the complaint is filed on 10.05.2017.
4.
On a perusal of the complaint, it is clear that the delay was explained, wherein it was clearly mentioned that a report was given to the police immediately after the incident and that no action was taken and that the complainant made complaint to all the higher officials, but in vain.
5.
The allegations in the complaint are that A2 to A4 snatched away the receipt executed by A1, for Rs.13 lakhs and that A1 collected huge amounts from the de facto complainant and thereby, cheated the complainant.
6.
From the above allegations, prima facie, it appears that the petitioner has committed the alleged offences. The nature of
the offences do not entitle the petitioner for an anticipatory bail. Hence, this court opines that this is not a fit case for granting anticipatory bail.
7.
With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
