HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.321 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus, declaring the action of respondent in ignoring the case of the petitioner for retransfer/posting to Head Office or any of its Units at Hyderabad, as illegal and arbitrary and sought consequential direction directing the respondent to consider the representation of the petitioner and post her at Head Office or any of its Unit at Hyderabad.

Heard Sri V.Hari Haran, learned counsel for petitioner and the learned Standing Counsel appearing for respondent. It has been contended by the petitioner that she was appointed as Record Assistant on 02.01.1992 on compassionate grounds. Subsequently she was promoted as Junior Assistant, Senior Assistant and also as Superintendent on 1.9.2017. She was posted at College of Agricultural Engineering, Kandi, Sangareddy District as Superintendent and she is working there till today. The grievance of the petitioner is that juniors to the petitioner who were promoted as Superintendents subsequent to the petitioner at various places, were brought back to the Head Office ignoring the case of the petitioner.

Learned counsel for the petitioner has contended that the petitioner has requested the respondent vide letter dated 31.12.2018 to consider her case for posting in the Head Office as Superintendent as done in the case of juniors to the petitioners and contended that appropriate orders be passed in the writ

petition directing the respondents to consider the representation/letter dated 31.12.2018 of the petitioner and pass appropriate orders.

Learned Standing Counsel appearing for the respondent has contended that it is prerogative of the University to post an employee at a particular place and the petitioner cannot contend that she may be posted at a particular post. However, learned Standing Counsel has contended that since the petitioner has submitted a representation to the respondent, appropriate orders would be passed on the said representation, in accordance with law.

This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the respondent to consider the representation of the petitioner dated 31.12.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With these observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
