HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.27118 of 2015 ORDER:

Heard.

The petitioner's complaint is against some villagers, who are stated to be interfering with his patta land admeasuring Ac.15-21 gts., in Sy.Nos.70, 73 and 127 situated at Kappapahad Village, Ibrahimpatnam Mandal, Ranga Reddy District. He made a complaint before the 2nd respondent on 24-072015 requesting him to protect his patta land from unauthorized interference by third party and alleging inaction on the part of the 2nd respondent in considering the said complaint, the petitioner has filed the present writ petition.

It is evident from the complaint itself that the petitioner has grievance against some third parties, who are stated to be obstructing enjoyment of patta land by the petitioner.

Since the matter pertains to purely civil right of the petitioner regarding his patta land and if the petitioner is aggrieved by interference by third parties, it is open for him to approach competent civil court and seek appropriate relief. The 2nd respondent cannot be expected to protect the petitioner's patta land against any interference.

The writ petition is clearly misconceived and it is accordingly dismissed. However, liberty is given to the petitioner to take appropriate recourse before competent court. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
