THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.236 of 2020 ORDER:

The present writ petition is filed questioning the inaction of the 3rd respondent-Station House Officer, Alwal Police Station, in not registering the FIR on the complaint made by the petitioner on 21.11.2019 with regard to the incident said to have been happened on 29.09.2019, as being illegal and arbitrary.

Heard Sri T. Sujan Kumar Reddy, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents 1 to 3. The learned Assistant Government Pleader for Home, on written instructions dated 06.01.2020, which is placed on the record of this Court, submits that the petitioner made a complaint on 21.11.2019 stating that on 20.09.2019 the 4th respondent came to her house and when her son opened the door, the 4th respondent kicked her son several times, further caught hold her throat and abused her, as such requested to take action.

The learned Assistant Government Pleader for Home on the basis of written instructions further submits that on receipt of the above complaint, the 3rd respondent authority made a GD entry and enquiry was done. During such enquiry, it disclosed that a case has been registered against

the petitioner's son in Crime No.456 of 2019 and further the alleged incident being complained off is stated to have happened on 20.09.2019, the complaint is made by the petitioner after a period of two months. Further, on perusal of the complaint, it discloses that the allegations regarding attracting of provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, not being correct, as such a notice was sent to the petitioner through registered post on 06.01.2020 informing that based on the said reasons, no action can be taken on her complaint. Having regard to the fact that the notice has been sent to the petitioner, which is not disputed by the learned counsel for the petitioner, no further orders are required to be passed in this writ petition, except observing that it is open for the petitioner to approach the appropriate forum to avail remedies in accordance with the law, if the petitioner is aggrieved by such notice.

Subject to the above observation, the writ petition is closed. However, there shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 27.01.2020 Isn
