THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27161 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus declaring the action of the first respondent in not permitting the petitioners to appear for the I year M.Tech (Regular) II Semester examination and I Semester Supplementary examination for the academic year 2015-16 scheduled to be commenced on 16.8.2016 as illegal and arbitrary.

2. At the time of hearing, the learned counsel for the petitioners seeks permission of this court to withdraw the writ petition with liberty to petitioners to approach the Apex Court in view of pendency of Special Leave to Appeal (C) No.2338 of 2016 filed by the fifth respondentCollege. Permission is granted.

3. Accordingly, the writ petition is dismissed as withdrawn granting liberty as prayed for. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
