HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.240 OF 2020 ORDER:

The present Writ Petition is filed for issuing a writ of mandamus directing the respondent Nos.2 to 4 in the Writ Petition to accord permission to the petitioners to conduct a Dharna/Deeksha on any working day between 06.01.2020 to 10.01.2020 for a period of 24 hours.

Heard learned counsel for the petitioner and Sri S. Sarat, learned Special Government Pleader.

When the matter was taken up on 06.01.2020, learned Special Government Pleader submitted that the place where the petitioner is seeking permission to hold Dharna/Deeksha is at Tahsildar office, Nawabpet, Mahabubnagar and the same cannot be considered as it would cause severe inconvenience to the general public apart from having regard to the recent incident at one of the Tahsildar office.

Learned Counsel for the petitioner, on the other hand, submitted that he would offer three alternate sites for holding such Dharna/Deeksha during the said period and the authorities shall consider granting permission for one of the said locations.

Today, learned counsel for the petitioner has given a list of three alternate sites for holding the said Dharna/Deeksha

on 10.01.2020 for a period of 24 hours. One among the said three alternate sites suggested by the petitioner was the location at new bus stand Nawabpet.

Learned Special Government Pleader submits that the authorities have no objection for grant of permission to hold Dharna/Deeksha by the petitioner at the location of "New Bus stand, Nawabpet".

Having regard to the above, since the petitioner has offered an alternate site for holding Dharna/Deeksha, the 2nd and 3rd respondent authorities are hereby directed to consider the application of the petitioner for according permission to hold Dharna/Deeksha at the location mentioned above, subject to other conditions and restrictions as the authorities may deem fit in the circumstances to be imposed having regard to the locally prevailing situation.

Subject to the above observation and direction, the Writ Petition is disposed of. No order as to costs. As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
