HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER CIVIL MISCELLANEOUS PETITION No.614 of 2014 ORDER:

This petition is filed under Section 24 CPC by the petitioner to withdraw O.P. No.55 of 2014 from the Court of the Senior Civil Judge, Miryalaguda, Nalgonda District and transfer the same to the Family Court, City Civil Courts, Hyderabad, for disposal in accordance with law.

2. Heard the learned counsel for both the parties and perused the material available on record.

3. The marriage of the respondent was performed with the petitioner on 13.2.2013 at Swagath Marriage & Function Hall, Kothapet, Hyderabad, as per Hindu rites and caste customs. After the marriage, the respondent joined the petitioner to lead marital life. The respondent filed O.P. No.55 of 2014 on the file of Senior Civil Judge Court, Miryalaguda, Nalgonda District, for dissolution of the marriage between her and the petitioner.

At the time of the arguments, learned counsel for the petitioner submitted that the respondent has been working as Junior Accountant in the Office of the Commissioner of Printing and Stationery, Hyderabad. The learned counsel for the respondent, while admitting the employment of the respondent, submitted that presence of the respondent before the trial court on each and every date of adjournment may be dispensed with.

5. Having regard to the facts and circumstances of the case, I am of the considered view that Hyderabad is a convenient place for both the parties and even if the presence of the respondent before the trial court is dispensed with, no prejudice will be caused to the petitioner.

6. In the result, the Transfer CMP is allowed. O.P. No.55 of 2014 is withdrawn from the Court of the Senior Civil Judge, Miryalaguda, Nalgonda District and transferred to the file of Family Court, City Civil Courts, Hyderabad, for disposal in accordance with law. The presence of the respondent before the Family Court, City Civil Courts, Hyderabad, on each and every date of adjournment in connection with O.P. No.55 of 2014 is hereby dispensed with. However, she shall appear before the trial Court as and when her presence is so required. Miscellaneous petitions, if any, pending in this transfer petition shall stand closed.
