HON'BLE SRI JUSTICE S.V.BHATT W.P.No.16799 OF 2006 ORDER:
The petitioner prays for the following relief: "......this Hon'ble Court may be pleased to issue a writ, order or direction particularly one in the nature of writ of Mandamus declaring the action of the Respondents in not considering petitioner's case for appointment as Attender on compassionate grounds as arbitrary and unreasonable and consequently direct the Respondents to consider his case for appointment as Attender in 3rd Respondent Institution or in any other Government Office on compassionate grounds, due to retirement of his father on medical invalidation grounds, as per the proceedings of the 2nd Respondent in Rc.No.
RSJK/254/2000 dated 16-.8.2001 and pass such other and further orders as this Hon'ble Court deem fit and proper in the circumstances of the case".
On 21.08.2006, the respondents were directed as follows: "There shall be a direction to the respondents to consider the claim of the petitioner for appointment in a suitable post, pursuant to the orders dated 16.08.2001, subject to the petitioner possessing requisite qualifications".
In view of the interim order, this Court is of the view that no further order is necessary.
The writ petition is, accordingly, disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any pending, also stand closed.
