HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.84 OF 2020 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, (Cr.P.C.), is filed by the petitioner/accused, for grant of anticipatory bail in Crime No.124 of 2019 of P.S. Narayankhed, Sangareddy District, registered for the offence punishable under Section 420 of the Indian Penal Code.

Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

In the FIR, it is inter alia stated that the accused cheated the complainant and other persons by stating that he is having much knowledge in running agriculture college and made proposal for establishing an agriculture college, thereby collected amounts from the complainant and other persons and thereby cheated them.

Learned counsel for the petitioner/accused would submit that the petitioner/accused has been falsely implicated by the respondent in the commission of alleged offence of cheating for no fault of him and the petitioner has nothing to do with the alleged transaction. It is further submitted that there is no transaction took place between the petitioner and the de facto complainant with respect to the above said allegations. It is further submitted that the petitioner is a law abiding and honest citizen and there is no probable circumstance to fasten the

economic liability to the petitioner. Hence, he prayed to grant anticipatory bail to the petitioner/accused.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/accused.

As seen from the contents of the F.I.R., there are specific allegations against the petitioner/accused.

Having regard to the facts and circumstances of the case, nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner/accused. The Criminal Petition is, accordingly, dismissed. Miscellaneous applications, if any, pending shall stand dismissed.
