THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.4157 OF 2015 ORDER:

The petitioner was appointed as fair price shop dealer of Thimmasamudram village, Jaladanki Mandal of SPSR Nellore District. While so, the 4th respondent issued a show cause notice, dated 26-112011 framing four charges against the petitioner and the petitioner submitted his explanation on 05-12-2011, However, the 4th respondent cancelled the authorization of the petitioner by order, dated 28-12-2011. Challenging the same, the petitioner preferred an appeal to the 3rd respondent and the 3rd respondent disposed of the said appeal on 3105-2012 confirming the order passed by the 4th respondent, dated 28-122011. Against the order of the 3rd respondent, the petitioner filed revision before the 2nd respondent and the 2nd respondent disposed of the said revision by order, dated 25-05-2013 directing the 4th respondent to give an opportunity to the petitioner and pass orders in a time bound manner within 2 weeks duly following the rules and regulations. When the proceedings were not disposed of by the 4th respondent, the present writ petition is filed.

Though the learned counsel for the petitioner drew attention of this Court to the order of cancellation of authorization passed by the 4th respondent, this Court is not inclined to go into the merits of the case in view of direction given by the 2nd respondent to the 4th respondent to pass orders in a time bound manner.

In the circumstances, the writ petition is disposed of directing the 4th respondent to comply with the order passed by the 2nd

respondent and pass final orders after giving due opportunity to the petitioner within a period of 30 days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
