ORAL ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondents.

Pursuant to tender notification called to award contract to execute erection of 11 KV LT Line, DTR's and Street Lights in the layout development at Survey Nos. 1 to 40, 300 to 321, Uppal section of Habsiguda division, Medchal zone, petitioner submitted his bid. In the present writ petition, the limited grievance of the petitioner is that though tenders were called and bids are received, respondents are not finalizing the tender process and the same is illegal and amounts to arbitrary exercise of power, therefore unconstitutional and seeks direction to finalise the tender process by opening the financial bids. 3.

Learned standing counsel for respondents on instructions, informs the Court that the tender notification is cancelled. 4.

Since decision is taken to cancel the tender notification calling for bids, no direction to open the financial bids and finalise the tenders can be granted. Therefore, the writ petition is dismissed, leaving it open to petitioner to work out remedies as available in law, if he is aggrieved by cancellation of notification calling for tender. Miscellaneous petitions, if any pending, are closed.
