The case of the petitioner is that his father while working as fair price shop dealer for Shop No.15 of Verampally Village, Manubolu Mandal died in the accident on 26.03.2016 and thereafter he applied for appointment as Fair Price Shop Dealer on compassionate grounds as envisaged in G.O.Ms.No.4, dated 19.02.2011; and that the same was rejected by the 3rd respondent on the ground that criminal case is pending against petitioner's father and also an order is passed under Section 6 A of the Essential Commodities Act, 1955, confiscating 20% of the seized stocks. It is also stated that petitioner filed appeal against the order of confiscation dated 20.10.2016 before the 2nd respondent and the same is pending.
Meanwhile, Respondent authorities are taking steps for filling up the vacancy of Shop No.15 for which the petitioner is claiming compassionate appointment. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies. It is to be seen that against the father of the petitioner, criminal case is filed and the same is dismissed as abated and the appeal filed by the petitioner against the confiscation order before the 2nd respondent is pending. In view of the same, the
2nd respondent is directed to dispose of the appeal filed by the petitioner against the confiscation order dated 20.10.2016 in RC.No.B.559/2016, within a period of two months from the date of receipt of a copy of this order. Pending such exercise, the respondents shall not make any permanent appointment to Fair Price Shop No.15 of Verampally Village, Manubolu Mandal, SPSR Nellore District.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 05.01.2018 t k.
