THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.154 OF 1997 JUDGMENT:

In fact, at the request of learned counsel for appellants, twice i.e., on 20.07.2016 and 10.08.2016, the matter was adjourned. On 17.08.2016, since there was no representation for the appellants, Registry was directed to list the matter under the caption 'for dismissal'.

2. Today, learned counsel for the appellants is present and reports no instructions, but, however, submits that possession of suit schedule property was already taken by the appellants.

3. The present appeal is preferred challenging the order, dated 19.06.1995, passed in I.A.No.215 of 1986 in O.S.No.331 of 1980 on the file of Additional Chief Judge, City Civil Court, Hyderabad (Temp), whereby and whereunder, the request for mesne profits made by the appellants-plaintiffs was allowed in part to the tune of Rs.1,73,750/- with interest at 12% per annum.

4. It appears that the appellants are not interested in prosecuting the appeal.

5. Hence, the appeal is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed. There shall be no order as to costs.
