HON'BLE SRI JUSTI CE T. VI NOD KUMAR WRI T PETI TI ON NO.283 OF 2020 ORDER:

This writ petition is filed questioning the inaction on the part of first respondent in not taking up hearing of revision petition filed by the petitioner under Section 6 of the Telangana (A.P) Scheduled Areas Land Transfer Regulation 1/1959 or the stay petition pending disposal of the revision and to declare the same as being illegal, arbitrary and violative of principles of natural justice.

Heard the counsel for the petitioner and the learned Government Pleader for Social Welfare.

It is the case of the petitioner that being aggrieved by the order of the second respondent in the writ petition the petitioner has filed the revision before the first respondent on 07.12.2019 and the same is pending consideration. In the meantime, while the said revision is pending consideration, the fourth respondent is taking steps to implement the order of the second respondent whereby the petitioner is sought to be dispossessed.

Since the revision petition filed by the petitioner is pending before the first respondent authority, this Court is of the view that ends of justice would be met if a direction is given to the first respondent to consider and dispose of either the revision petition or the stay application filed by the petitioner against the order of the second respondent protecting the interest of the petitioner in the meanwhile.

Hence, without expressing any opinion on merits of the matter, the writ petition is disposed of directing the first respondent to consider and dispose of either the stay application or the revision petition on merits in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Till then, the petitioner shall not be dispossessed from the land in question.

Subject to the above direction, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
