O R D E R
This writ petition was filed assailing the proceedings dated 07.01.2011 (wrongly mentioned as 07.01.2010) issued by the Director of Mines and Geology, Government of Andhra Pradesh, and the consequential proceedings dated 11.01.2011 of the Deputy Director of Mines and Geology, Kakinada, East Godavari District, amending the grant orders, whereunder the area allotted to the petitioner firm on lease for quarrying colour granite was reduced from 10.80 hectares to 9.925 hectares. This land was situated in Sy.No.73 of Pedda Mallapuram Village, Sankavaram Mandal, East Godavari District. By interim order dated 25.01.2011, this Court directed that the mining authorities shall not grant any lease in respect of the land admeasuring 0.875 hectares in Sy.No.
73 of Pedda Mallapuram Village, Sankavaram Mandal, East Godavari District, which was the extent reduced from original grant of the petitioner. While so, the Assistant Director of Mines and Geology, Rajahmundry, addressed letter dated 29.05.2012 to the Director of Mines and Geology, Government of Andhra Pradesh, setting out the issues involved comprehensively and requested the Director of Mines and Geology, Hyderabad, to dispose of the pending applications, including that of the petitioner firm.
The learned Assistant Government Pleader for Mines and Geology, states that this letter is still awaiting consideration by the said authority.
In that view of the matter, this Court sees no purpose served in
independently adjudicating the issues arising in this writ petition on merits when the authority concerned is already seized of the matter. The writ petition is accordingly disposed of directing the Director of Mines and Geology, Government of Andhra Pradesh, to consider the pending applications in the light of the letter dated 29.05.2012 addressed by the Assistant Director of Mines and Geology, Rajahmundry, and take appropriate action thereon in accordance with law. All the points raised by the petitioner firm in this writ petition shall be taken into consideration by the Director while disposing of the petitioner's application in so far as the reduced extent is concerned. This exercise shall be completed expeditiously and in any event, not later than two months from the date of receipt of a copy of this order.
