THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.254 of 2020 ORDER:

The present writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to declare the action of the respondents 4 & 5 in interfering with personal lives and liberty of the petitioners, as illegal, arbitrary and in violation of the Articles 14 and 21 of the Constitution of India.

Heard Sri Papaiah Peddakula, learned counsel for the petitioners and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home, on written instructions dated 06.01.2020, which is placed on the record of this Court, submits that based on a complaint of one Yashoda Pallepati, a case was registered in Crime No.135 of 2019 of Thurkapally Police Station on 18.12.2019 for the offence punishable under Section 384 of the Indian Penal Code, 1860, wherein the petitioners 1 to 3 herein are arrayed as accused Nos.1 to 3.

The learned Assistant Government Pleader further submits that upon registration of the above crime, the 5th respondent-Station House Officer, Thurkapally Police Station took up investigation and in connection with the investigation of said crime only the petitioners were called to the police

station. By the said written instructions, it is also stated that except doing investigation in the said crime, the respondent police authorities never interfered in the civil disputes of the petitioners at any point of time.

Recording the above said statement on behalf of the respondent 4 and 5, no further orders need be passed in this writ petition.

Accordingly the writ petition is closed. However, there shall be no order as to costs.
