The limited grievance of the petitioners in the present writ petition is that though they have submitted Form-VI (A), under Rule 18 read with Section 4(1) of the Act, Intimation by any person regarding acquisition of rights, for issuance Pattadar pass books to the 4th respondent, Tahsildar, his authority is not considering and passing any orders on it.
According to the learned counsel for the petitioners, due to the inaction on the part of the 4th respondent, Tahsildar in considering the said Form-VI dated 12.06.2018, petitioners are causing much inconvenience. Hence, they filed the present writ petition.
On the other hand, the learned Government Pleader for Revenue would submit that Form-VI (A) dated 12.06.2018, stated to have been submitted by the petitioners, pertains to only three survey numbers and whereas, in the present writ petition, petitioners are claiming right over the eight survey numbers. As could be seen from the material placed on record, it is clear from Form VI (A) dated 12.06.2018 that only three survey numbers are mentioned therein and in the present writ petition, petitioners claiming right over the eight survey numbers. Hence, this Court feels that it is appropriate to dispose of this writ petition with the following direction.
KL, J W.P. No.611 of 2020 This writ petition is disposed of directing the 4th respondent, Tahsildar, to consider the Form-VI (A) dated 12.06.2018 in respect of the land in Sy.Nos.21/1, 29/2 and 43/2 and pass appropriate orders, strictly in accordance with law and communicate a copy of the said order to the petitioners within a period of four weeks, from the date of receipt of a certified copy of this order. Accordingly, this writ petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any pending, shall stand closed.
