According to the petitioner land to an extent of Ac.12.78 cents out of Ac.60.10 cents in Sy.No.321/2C and 2J of Kakkalapalli Village, Anantapuramu District, belong to the grand mother of the petitioner, who purchased from Talari Lingappa on 12.08.1944. Father of the petitioner succeeded to the said property. Out of Ac.12-78 cents, Ac.11.19 was sold and Ac.1-59 cents remained in possession and enjoyment of the petitioner. Petitioner alleges that wrong sub-division was made without following the records. Therefore, on 16.09.2017, petitioner submitted an application for fresh sub-division by looking into the records. Alleging inaction on the said application, this writ petition is filed.

However, learned Assistant Government pleader, pointed out that the petitioner is not only asking for re-subdivision but also asking for re-survey and both cannot be sought. 4.

A bare perusal of the said representation and the mee-seva receipt would disclose that what is sought by the petitioner is resubdivision. That being so, the Writ Petition is disposed of without expressing any opinion on merits directing the Tahsildar, Ananthapuramu to examine the claim of the petitioner and pass appropriate orders, as warranted by law, by following the due procedure, as expeditiously as possible, preferably within a period

- 3 - of three (3) months from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
