Heard before admission and before notice to respondent No.2.

The Criminal Petition is disposed of, without making any observations, by left open all defences including any remedy to move the trial Court with an application for discharge if no grounds to consider on merits and if at all to impugn any charges so framed. Needless to say for the difficulty expressed by the 1st petitioner/Accused No.1 from the ill health, liberty is given to file an application under Rule 37 Criminal Rules of Practice for the 2nd petitioner/Accused No.2 to represent Accused No.1 in the proceedings but for personal appearance if at all directed to appear.
