O R D E R

This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A-8 seeking enlargement on bail in connection with Crime No.18 of 2025 of Atmakur Police Station, Wanaparthy District. The offences alleged against the petitioner are under Sections 310(2) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

The brief facts of the case are that, on 18.02.2025, the de-facto complainant lodged a report with the police stating that some unknown persons have committed theft of 30 pigs from the possession of the de-facto complainant and at the time of commission of offence, they also attacked the de-facto complainant and other persons and they sustained injuries and the pigs stolen by the unknown persons are worth of Rs.90,000/-.

Hence, the complainant requested for necessary action. Based on the said complaint, the police registered a case against the petitioner and other accused for the aforementioned offences.

The investigation was completed and filed charge sheet in the month of August. While the petitioner was absconding, he was subsequently taken into judicial custody on 01.10.2025 pursuant to PT warrant issued on 22.09.2025.

Heard Sri S. Bhaskar, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the alleged offences and has

- 3 - been in judicial custody for more than 100 days and the remaining accused were already granted bail by the trial Court and the entire investigation is already completed and the charge sheet is also filed. Therefore, he prayed this Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, on the ground that, the petitioner herein is habitual offender and he was involved in other five crimes for the similar offences, therefore, he is not entitled for the bail. However, the investigation was completed and the charge sheet was also filed in the month of august and the PRC is pending before the concerned Court vide PRC No.7 of 2025 and prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner is in jail since 01.10.2025 in the present case and as seen from the record, the entire investigation is already completed and the charge sheet is also filed. Considering the overall facts and

- 4 - circumstances of the case, including the nature of the allegations, the completion of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused No.8, subject to the following conditions:

i.

The petitioner/accused No.8 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned JCJ-cum-JFMC at Atmakur, Wanaparthy District, TG.

ii.

The petitioner/accused No.8 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused No.8 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

The Respondent is at liberty to file cancellation of bail, if the petitioner is involved in similar offence.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
