Shah Gulam Nakshband Hafeez Pasha, v. The Administrator-Cum-Hon I Additional Senior Civil Judge

THE HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.3279 OF 2015 ORDER:- This Civil Revision Petition is filed under Article 227 of the Constitution of India seeking direction for disposal of O.S.No.65 of 2011 on the file of the Andhra Pradesh State Wakf Tribunal, Hyderabad (for short, "the Tribunal").

2. The aforesaid suit was filed under Section 83(2) of the Wakf Act, 1995 (for short, "the Act") for declaration of Anumasamudrampet Dargah as independent institution by cancellation of the scheme formulated in O.S.No.50 of 1913 on the file of the Hon'ble Senior Civil Judge, Nellore. It is the grievance of the petitioners that though evidence was completed, the suit is being adjourned from time to time without assigning any reason.

3. Learned counsel for the respondents submits that the evidence is not completed and the suit is coming for the evidence of the respondents. It is also brought to the notice of this Court that presently, there is no Presiding Officer to the Tribunal.

4. In the aforesaid circumstances, as it is stated that the suit is coming up for the evidence of the respondents, the Civil Revision Petition is disposed of with a direction to the Tribunal to dispose of the aforementioned suit as expeditiously as possible by avoiding unnecessary adjournments. It is open for the petitioners to bring to the notice of the Tribunal along with a memo about this order. There shall be no order as to costs.

5. Miscellaneous Petitions pending, if any, in this Civil Revision Petition shall stand closed.
