ORDER
This writ petition under Article 226 of Constitution of India is filed by petitioner seeking to declare the action of respondents 2 and 3 in not providing personal police security with armed police personnel to his life and property on his representation dated 17.10.2016 though there is an imminent and serious threat to his life in the hands of unsocial elements and local goondas, as illegal and arbitrary.

It is stated in the affidavit that the petitioner incorporated a company in the name and style of M/s. Ashish Infra Developers (India) Private Limited, under the Companies Act, 1956, for development and construction works and he is also the Treasurer of opposition political party (TDP) in the State. It is stated that though he obtained injunction order from the civil Court for construction work with regard to subject property, the owners of property are threatening him with dire consequences if he did not stop construction. Therefore, he made a representation dated 17.10.2016 to the 2nd and 3rd respondents to provide personal police security with armed police personnel to his life and property, but no action has been taken thereon. Hence, he filed the present writ petition.

Learned Assistant Government Pleader informed this Court stating that on earlier occasion, as per the orders of the civil Court, police protection was given to the property of petitioner and that if there is any life threat, petitioner is at liberty to give representation to the State
RE, J W.P.No.39838 of 2016 Level Security Review Committee informing the grounds on which he needs police protection.

In view of the submission of learned Assistant Government Pleader and without going into the merits of the matter, I deem it appropriate to direct the petitioner to make a representation before the State Level Security Review Committee informing the grounds on which he needs police protection from whom he is receiving threat, and on such representation, the said authority is directed to dispose of the same in accordance with law.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
