It is noticed that both the appeals arise out of the Judgment and Decree in O.S.No.83 of 1984 on the file of the Principal Subordinate Judge, Chittoor. However, this appeal is against the Order, dated 21-09-1995, of the Court below by and under which O.S.No.83 of 1984 was dismissed for default.

Subsequently, it appears that the said suit was restored and by Judgment, dated 20-12-1996, the learned trial Court has dismissed the suit on merits. Aggrieved by which A.S.No.612 of 1997 is filed. In view of the above, A.S.No.2779 of 1996 is superfluous. Therefore, the same is dismissed as infructuous, inasmuch as, A.S.No.612 of 1997 filed against the same jt and decree is pending adjudication.
